ACCEPTANCE OF TERMS

These Terms of Use ("Terms") govern your (hereinafter, "you") use of the MyTarotTable Platform (as defined below) provided by MiniFireDragon Studios, Inc. ("MiniFireDragon Studios") that gives Members (as defined below) the opportunity to pay Creator's (as defined below) to supply them with personalized tips, materials, mentorship and advice (the "Services"). By acessing, registering for and/or using the MyTarotTable Platform and/or any part of the Services, you agree to be bound by these Terms. If you do not agree to these Terms, then you may not register, access and/or use the MyTarotTable Platform and/or the Services or any portion thereof. Your right to the the MyTarotTable Platform and/or the Services is expressly conditioned upon your consent to these Terms.
MiniFireDragon Studios reserves the right, in its sole discretion, to revise or modify these Terms at any time, and you agree to be bound by such revisions or modifications. You are responsible for viewing these Terms periodically. Your continued use of the MyTarotTable Services and/or the Platform after a change or modification of these Terms has been made will constitute your acceptance of the revised Terms. If you do not agree to these Terms, your only remedy is to discontinue your use of the Services and/or the Platform and to cancel any account(s) you have created for use of the Services and/or the Platform.
If you violate these Terms, MiniFireDragon Studion reserves the right to issue you a warning regarding the violation or to immediately terminate or suspend all or part of the account(s) you have created for using the MyTarotTable Platform and/or the Services. You agree that MiniFireDragon Studios does not need to provide you notice before suspending or terminating your account(s), but it may provide such notice in its sole discretion.
You agree that MiniFireDragon Studios may change any part of the Services and/or Platform, at any given time or discontinue use of the Services and/or the Platform or any part thereof, for any reason, without notice to you and without liability. You declare that by acceptance of these Terms and/or by using the Services and/or the Platform you are of legal age to form a binding contract with MiniFireDragon Studios or under the strict and continuous supervision of a parent or any other qualified legal guardian, and in any case, at least 18 years of age. You may not use the Services and/or the Platform and may not accept these Terms if you are a person barred from using the Platform or providing the Services under the laws of the country in which you are resident or from which you provide Services and/or use the Platform.

DEFINITIONS

Unless otherwise defined in these Terms, capitalized terms used in these Terms shall have the following meanings:

"Creator" means the provider of the Services.

"End User" or "Member" means an end-user using the Platform, viewing content, and engaging with the Creator through the MyTarotTable Platform.

"Intellectual Property" means all property, whether in the form of ideas, methods, procedures, designs, formulas, creations, apparatus, improvements, inventions, works of authorship and other similar material, whether subject to protection under copyright, patent or trade secret law or any other statutory provision or common law doctrine.

"Platform" or "MyTarotTable Platform" means the MiniFireDragon Studios content distribution and display platform & products owned and managed by MiniFireDragon Studios, which enables display of digital content and distribution by Creator's to End Users.

"Updates" means any upgrades, patches, error corrections, bug fixes, maintenance releases, minor releases, new versions or other modifications or enhancements developed, released, or issued by MiniFireDragon Studios with respect to the Platform. Any Update made available hereunder shall constitute and be deemed to be part of the MyTarotTable Platform.

PLATFORM LICENSE

Grant of License. Subject to the terms herein, MiniFireDragon Studios hereby grants you a non-exclusive license, non-transferable, for the term hereof, to use the MyTarotTable Platform in accordance with the terms hereof.
License Limitations. Unless expressly agreed herein, you shall not
1. decompile or reverse engineer (except to the limited extent expressly authorized by applicable statutory law) any computer code provided to you in connection with MyTarotTable Platform, create or modify any derivative works of any portion or all of the MyTarotTable Platform, including localization or translation;
2. sublicense, encumber, redistribute, sell, lease, rent, use the MyTarotTable Platform in a service bureau arrangement or timesharing, or otherwise transfer rights to all or any portion of the MyTarotTable Platform;
3. copy any portion or all of the MyTarotTable Platform; or
4. remove any copyright, logo, trademark, or other proprietary notices, symbols, labels, or legends in the MyTarotTable Platform, unless MiniFireDragon Studios has given written consent.
Use of MyTarotTable Platform. You agree to use the MyTarotTable Platform in accordance with all applicable laws and shall not use it for any purpose other than that which is intended pursuant to the terms hereof.

TWITCH API SERVICES

Use of Twitch API Services. Our application uses Twitch API Services to provide certain features and functionalities. If you choose to use our Platform in conjunction with the Twitch API Services, you agree to be bound by the Twitch Terms of Service.
Data Control and Revocation. To request deletion of your stored data related to Twitch API Services, please contact us at support@mytarottable.com. We will process your request within 30 days.

CONTENT AND SERVICES

The Platform. You hereby represent and warrant that, except as expressly provided herein, the MyTarotTable Platform constitutes only a platform which may be used to use and/or provide the Services, connect with Members and/or Creator's and review and/or upload Creator Content (as defined below).

Creator Content, User, and Services.

Any and all messages, questions, video, information, graphics, links, text, data, offer, notifications, or other materials uploaded by you and being displayed to Creator's through the MyTarotTable Platform ("User Content"), are done at your sole responsibility.
Any and all messages, questions, video, information, graphics, links, text, data, offer, notifications, or other materials, uploaded by you and being distributed and/or displayed to End Users (collectively, the "Creator Content"), are at your sole responsibility. You shall be fully responsible for updating, modifying, and supplementing Creator Content and for the provision of the Services to the Members.
Each of the Creator Content and User Content uploaded to the Platform by you is hereinafter referred to together as "Created Content".
When using features that interact with Twitch API Services, you acknowledge that additional data might be collected and stored as per our use of these services. This data is subject to the data control and revocation procedures outlined in the TWITCH API SERVICES section of these Terms.
You hereby represent and warrant that any Created Content being uploaded to the MyTarotTable Platform by you, is being provided in accordance with any applicable law, including, without limitation, any anti-spam, applicable privacy, ad data protection laws.
You hereby grant to MiniFireDragon Studios a worldwide right, royalty-free, non-exclusive, and license during the term hereof to do the following to the extent necessary to the provision of the Platform in accordance with these Terms: (1) store, reproduce, transmit, publish, upload, distribute, digitize, arrange, convert, compile, order, combine, select, synchronize, process, use, install, publicly display, retrieve, hyperlink and publicly perform Created Content; and (2) make back-up or archival copies of Created Content.
Except for the rights expressly granted above, MiniFireDragon Studios is not acquiring any interest in, title, or right to Created Content, does not claim ownership on Created Content, does not control Created Content, and, as such, does not guarantee the quality, accuracy, or integrity of Created Content.
You hereby agree and confirm that MiniFireDragon Studios may use the Created Content on the MyTarotTable Platform as it deems fit and at its sole discretion. Without derogating from the aforesaid, you may request that specific Created Content will be removed and MiniFireDragon Studios shall remove such Created Content from the MyTarotTable Platform within 10 days.
Under no circumstances will MiniFireDragon Studios be liable in any way for any Created Content or for any damage or loss of any kind to Created Content or that is incurred as a result of the use of any Created Content displayed and/or distributed and/or uploaded and/or otherwise made available via the MyTarotTable Platform.
MiniFireDragon Studios reserves the right to remove or edit any Created Content that it becomes aware of and determines to be offensive, harmful, or otherwise in violation of these Terms and/or any applicable law. MiniFireDragon Studios may also remove any Created Content that is inaccurate or includes personal information or unauthorized disclosure.
You shall not make available through the MyTarotTable Platform any Created Content that violates or includes child pornography, harm minors in any way, defamatory, libelous, racist, is obscene, excessively violent, harassing, infringes any third party's intellectual property rights or otherwise objectionable.
You shall not use the Platform in any way for posting, emailing transmitting, uploading, or otherwise making available any unauthorized or unsolicited advertising, junk mail, promotional material, chain letters, spam, or any other form of solicitation except as specifically permitted under any applicable law.
You shall not pretend to be someone else when using the MyTarotTable Platform or when using or providing the Services.
You shall not make available through the MyTarotTable Platform any Created Content that contains any other computer code or software viruses, programs or files designed to limit, interrupt, or destroy the functionality of any computer hardware or software or telecommunications equipment.
You shall not use the MyTarotTable Platform for any unlawful activities not otherwise covered above. Without derogating from the generality of the foregoing, you shall not use the MyTarotTable Platform to:
1. unintentionally or intentionally violate any applicable local, state, federal, national or international law, or any regulations having the force of law;
2. impersonate any person or entity, including, but not limited to, a MiniFireDragon Studios official, or falsely state or otherwise misrepresent its affiliation with a person or entity;
3. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Created Content made available through the MyTarotTable Platform or develop images or hidden pages;
4. make available through the MyTarotTable Platform any Created Content that does not hold a right to be transmitted to the public under any law or under contractual or fiduciary relationships.
MiniFireDragon Studios does not pre-screen Created Content, however, MiniFireDragon Studios and its designees have the right (but not the obligation) in their sole discretion to restrict access to or block the availability of, or to disable, any Created Content that is made available through the MyTarotTable Platform. Without limiting the foregoing, MiniFireDragon Studios and its designees may disable, restrict access to or the availability of, any Created Content that violates these Terms, any applicable law or is otherwise objectionable. If you are a Creator, you shall evaluate, and bear all risks associated with, the use of any Creator Content, including any reliance on the quality, integrity, usefulness, or accuracy of such Creator Content.
You consent, agree, and acknowledge that MiniFireDragon Studios may access, preserve and disclose any Created Content and if required to do so under any applicable law or if it believes such discloser is necessary to enforce these Terms and/or respond to claims that Created Content violates the rights of any third party and/or to protect the rights, property or safety of MiniFireDragon Studios, its users and/or the public.
Unless otherwise explicitly stated, herein, any Created Content made available through the MyTarotTable Platform shall be deemed to be provided on a non-confidential and nonproprietary basis. You acknowledge that you are responsible for Created Content that is submitted, and shall have full responsibility for Created Content, including its copyright, appropriateness, originality, reliability, and legality.

Creator Content. Review and use of any and all promotional materials, messages, video, information, graphics, links, text, answers data, offers, notifications, or other materials, available to you and being displayed and/or distributed to you by Creator's (collectively, the "Creator Content"), are at your responsibility. MiniFireDragon Studios does not pre-screen and shall have no liability under no circumstances for or with respect to any Creator Content. You may not, without Creator's prior written approval, publish and/or distribute the Creator Content. You shall evaluate, and bear all risks associated with, the use of any Creator Content, including any reliance on the quality, usefulness, integrity, or accuracy of such Creator Content.

Members Content. MiniFireDragon Studios does not pre-screen and shall have no liability under no circumstances for or with respect to any content provided to Creator by Members, including without limitation, any questions, and requests submitted by Members on the MyTarotTable Platform. You may not, without Member's prior written approval, publish and/or distribute such Members Content.

MiniFireDragon Studios Content Services. Notwithstanding anything to the contrary in this Section 5, MiniFireDragon Studios may display and/or distribute and/or otherwise make available to you, or any other Creator's or Members, any other content (the "MiniFireDragon Studios Content") in addition to, or instead of, the Created Content.

SESSIONS RECORDINGS AND ACCESS

To support a safe and seamless experience, MyTarotTable automatically records all interactions between Members and Creators. This includes live video, audio, chat sessions, recorded readings, and written responses.

These recordings are made available for private viewing, download, or playback through each participant's MyTarotTable account, depending on the service format.

By using MyTarotTable, you agree to this secure recording and storage, and you grant us a limited license to:

Deliver your purchased services
Support quality assurance and safety
Fulfill legal or compliance obligations when required
Provide you with access to your past sessions
Assist in technical troubleshooting or dispute resolution

Only trained MyTarotTable staff may access these materials in specific, logged cases — and never for advertising or public use.

Externally Delivered Content

In some cases (especially recorded readings), Creators may choose to share content through private links hosted on platforms like YouTube, Twitch or other Social Media Platforms. When this happens:

MyTarotTable does not store or control these external files
If the Creator removes the content or deletes their account, access may be lost
Clients are encouraged to save any externally linked content promptly (if allowed)

Ownership and Responsibility

MyTarotTable does not claim ownership, but retains the necessary rights to store, transmit, and enable access to content as part of its services. Deleting your account ends your personal access, but content already shared with a Member remains visible to them.

Creators fully own the content they produce. Members are granted a non-commercial, personal license to access it.

MYTAROTTABLE AFFILIATES

Creators may be engaged in the "MyTarotTable Affilite" program under the following conditions:

Creator has been formally invited by MyTarotTable to become an Affiliate via email.
Creator has formally agreed to be part of the program via email confirmation to the initial email outreach.
Participation in the Affilite program does not constitute employment or engagement of any kind beyond the terms outlined below.
Creator may be asked to produce promotional materials as part of their participation in the program. Promotional material may be used in social media channels, email outreach/newsletter and other recruitment, branding, marketing, and success efforts.
Promotional materials may be changed or edited without modifying the essence of the original promotional items — i.e. editing a video shall not be done in a way that changes the intent or message of the creator in the original video.
Qualified Leads: a potential new creator will be considered a qualified lead registered to the Affilite according to the following criteria:
- the lead clicks on a link in a promotional item including a creator's testimonial or other promotional item and has not previously created a MyTarotTable profile.
- a lead clicks on a link related to and including the Affilite's promotional item provided via social media or other marketing outlet, and this contact has not previously signed up or created a MyTarotTable profile prior to interacting with promotional materials.
If a qualified lead registers for MyTarotTable and creates a profile, all selling activity (both revenue and refunds) generated by that lead for the agreed period of time will be shared with the Affilite according to the agreed percentage which shall be defined in the invitation email to the program and will be considered as having been agreed to by the creator upon receipt of his confirmation mail.
If the Affilite, during the period he is registered as such, provides to MyTarotTable leads that he or she has gathered independently and who have not previously created a MyTarotTable profile, the same terms and conditions for revenue sharing will apply.
All responsibility and obligations related to the provision of services on MyTarotTable will be the sole obligation of the creator with whom a member has contracted the service and not of the Affilite.
Any revenue generated for the Affilite from this program will be collected in the creator's balance and may be withdrawn according to the procedures and conditions outlined elsewhere in the terms of service.
Either MyTarotTable or the Affilite may terminate the Affilite's participation in the program at any time for any reason. Financial obligations related to qualified leads registered until termination will survive through the end of the agreed term.
A qualified lead ceases to be considered a qualified lead if he or she has not registered with MyTarotTable within 6 months of becoming a qualified lead.
MyTarotTable may change the terms of service from time to time. Advisors will be notified by mail that changes have been made.

REVENUE SHARING

If you are a Creator, the following fees and commissions apply to activity on the Platform:

8.1 All Services

Payment Processing Fee: 8% of the gross session value, with a 10% commission.

For the initial launch of this service, the following applies for the first 6 months:

On earning up to $500 per month: Payment Processing Fee: 8%, with a 2% commission
On earning above $500 per month: Payment Processing Fee: 8%, with a 10% commission

8.2 Revenue Withdrawal

Payouts of your revenue share will occur 15 days after the end of the month providing your account balance if $50 or greater at the end of the month. No payment will be made for amounts under $50, except upon account closure as described in Section 13. Revenue collected from buyers becomes eligible for withdrawal no earlier than 5 days after receipt by MiniFireDragon Studios. Each party is solely responsible for any applicable taxes, duties, or fees.

SCHEDULED SESSIONS

In addition to on-demand sessions, the MyTarotTable Platform enables Member to pre-book one-on-one sessions with Creators at scheduled times.

9.1 Scheduled Sessions. Scheduled Sessions allow Members to reserve time in advance with a Creator for a defined service, with pricing and duration set by the Creator. These sessions are part of the MyTarotTable Services and are subject to these Terms.

9.2 Scheduling and Booking Process. All Scheduled Sessions must be booked through the MyTarotTable Platform. Followers select from time slots made available by the Creator. Payment is authorized but not collected at the time of booking. A session is confirmed only after successful authorization.

9.3 Creator Responsibilities. Creators offering Scheduled Sessions must maintain a calendar of availability. Creators are expected to honor all confirmed sessions. Missing a session without appropriate cancellation may result in forfeited earnings and account penalties, including potential suspension. If a cancellation is necessary, Creators must use the "cancel session" at least one hour before the session start time.

9.4 Member Responsibilities. Members are responsible for joining their session on time. If a Member fails to join within 10 minutes of the scheduled start time, they will be marked as "Missed" and will be charged a 15% fee of the session value unless MyTarotTable determines otherwise.

9.5 Cancellation and Rescheduling Policies.

Member-Initiated Cancellation: Members may cancel or reschedule up to 24 hours before the session start time. Cancellations made within 24 hours are charged a 15% fee unless approved by the Creator or MyTarotTable.
Creator-Initiated Cancellation: Creators should only cancel in exceptional circumstances. They must cancel through the platform at least one hour in advance. Creators who miss a confirmed session without prior notice may forfeit compensation and face penalties.

9.6 Refunds for Scheduled Sessions. Refunds are handled under Section 14 (Refund Policy) of these Terms:

If a Creator cancels or fails to attend, the Follower receives a full refund.
Refunds due to technical issues are issued at MyTarotTables's discretion, based on session review. Client-side connection issues may not be eligible for a refund; Creator-side issues may result in forfeited revenue. Creators are expected to have stable internet and a functioning device during sessions.

9.7 Late Attendance.

Creator Late: If a Creator is more than 5 minutes late without prior notice, the Member may request a cancellation and a full refund. This does not apply if the Creator was in a session with a Member.
Follower Late: If a Follower joins late but within 10 minutes of the start time, the session begins and may not be available for extention depending upon other Creator Bookings. Creators must remain available for the full 10-minute grace period.

9.8 Additional Conditions. All other terms applicable to MyTarotTable Services apply equally to Scheduled Sessions, including those related to Content, Revenue Sharing, Confidentiality, and Limitations of Liability. MyTarotTable may revise these policies at any time, including changes to cancellation windows, penalties, and other operational details.

PAY-PER-MINUTE SESSIONS ("PPM Sessions")

In addition to Scheduled Sessions, the MyTarotTable Platform enables real-time, on-demand sessions between Members and Creators, billed by the minute. By participating in or offering PPM Sessions, you agree to the following terms:

10.1 PPM Sessions. PPM Sessions allow Members to connect with available Creators immediately through voice, video, or chat. These sessions are billed per-minute at a rate determined by the Creator, with charges beginning upon session start. PPM Sessions are considered part of the MyTarotTable Services and are governed by these Terms.

10.2 Creator Responsibilities. Creators who choose to offer PPM Sessions must make themselves available via the Platform during times of their choosing. Creators must maintain device readiness and a stable internet connection while marked as available. Creators must respond promptly to incoming requests to ensure a reliable experience for Members.

10.3 Member Responsibilities. Members are responsible for initiating the session and maintaining connection throughout. Charges begin once the Member starts the session and continues until either party ends the session or funds for the session are expended. It is the Member's responsibility to ensure their device and connection are functioning prior to engaging.

10.4 Billing and Charges. PPM Sessions are billed in fixed time increments (e.g., 10-minute blocks or the average time of the service) based on the Creator's rate. If a session ends with unused minutes in the final increment, the unused portion will be credited back to the Member's charge method, and the remaining unspent portion will not be charged.

All billing is subject to real-time metering via the Platform. MyTarotTable reserves the right to adjust increments or rates for operational reasons and will notify users of such changes.

10.5 Technical Issues. In the event of disconnection, MyTarotTable will evaluate session duration and context to determine whether a refund or credit is appropriate. Refunds will not be issued for Member-side disconnections unless deemed justified by MyTarotTable. Creator-side disconnections may result in forfeited earnings.

10.6 Abuse and Misuse. Repeated abuse, such as initiating PPM Sessions without intent to engage, harassment, or other forms of misuse, may result in account suspension or permanent ban, at MyTarotTable's sole discretion.

10.7 Additional Conditions. All other limitations, obligations, rights, and disclaimers applicable to Services under these Terms (including but not limited to Content, Revenue Sharing, Confidentiality, and Limitation of Liability) apply equally to PPM Sessions. MyTarotTable reserves the right to modify PPM Sessions policies at any time.

INTELLECTUAL PROPERTY

MiniFireDragon Studios Intellectual Property. The MyTarotTable Platform is licensed to you for use, not sold. The MyTarotTable Platform is protected by other intellectual property laws, by international treaties, and copyright law. The MyTarotTable Platform, including its structure, organization, and code constitute valuable trade secrets of MiniFireDragon Studios and its vendors. All rights, interest in, and title and to (i) the MyTarotTable Platform, including any and all copies documentation that may be included in, or provided in connection with, the MyTarotTable Platform; (ii) any reports or analyses prepared by MiniFireDragon Studios in connection with the use of the MyTarotTable Platform; and (iii) any know-how or Intellectual Property contained in or associated with the foregoing is owned by and shall remain with MiniFireDragon Studios and/or its vendors. You acknowledge such ownership and Intellectual Property rights and will not take any action to jeopardize, limit or interfere in any manner with MiniFireDragon Studios's or its vendor's ownership of, or rights with respect to, the MyTarotTable Platform. You agree that MiniFireDragon Studios shall have any and all right, title, and interest in and to any and all modifications, design changes or improvements of the MyTarotTable Platform suggested by you or any other party, without the payment of any additional consideration therefore to you or any other party, and that you will take all actions and do all things reasonably necessary, at MiniFireDragon Studios's sole expense, to aid MiniFireDragon Studios to protect such rights.

Except as explicitly provided herein, MiniFireDragon Studios does not grant any licenses implied or express. All rights not explicitly granted are reserved by MiniFireDragon Studios.

Twitch API Services are subject to their own terms and conditions as provided by Twitch. Our use of Twitch API Services does not grant us any ownership or rights over Twitch's intellectual property.

CONFIDENTIALITY

You acknowledge that, in the course of using the MyTarotTable Platform, you may obtain or develop information relating to the MyTarotTable Platform and/or to MiniFireDragon Studios ("Proprietary Information"), including, but not limited to, documentation, know-how, ideas, marketing, technology, problem reports, interfaces, testing procedures, performance information, structure, and analysis and other technical, product, business, and financial information, data, and plans. During and after the term hereof, you shall hold in confidence and protect, and shall not use (except as expressly authorized by these Terms) or disclose, Proprietary Information, unless such Proprietary Information becomes part of the public domain without breach of these Terms by you. You acknowledge and agree that due to the unique nature of MiniFireDragon Studios's Proprietary Information, there can be no adequate remedy at law for any breach of your obligations hereunder, that any such breach may allow you or third parties to unfairly compete with MiniFireDragon Studios resulting in irreparable harm to MiniFireDragon Studios, and therefore, that upon any such breach or threat thereof, MiniFireDragon Studios shall be entitled to injunctions and other appropriate equitable relief in addition to whatever remedies it may have at law.

TERMINATION

Termination upon Written Notice. These Terms shall remain in effect and full force for an unlimited period unless the account of such Creator or Member is terminated by either Party with a fourteen (14) days prior written notice to the other Party.
Termination for Cause. Without prejudice to any other rights or remedies, MiniFireDragon Studios may, notwithstanding Section 13.a of these Terms, terminate these Terms immediately upon the occurrence of one or more of the following events: (i) all or a substantial part of the assets of you are sold or otherwise transferred to any person; (ii) you are merged or consolidated with any other entity; (iii) a receiver, trustee, or liquidator of you is appointed for any of your property or assets; (iv) you admit in writing your inability to pay your debts as they mature; (v) you make a general assignment for the benefit of creditors; (vi) you are adjudicated as bankrupt or insolvent; (vii) a petition for the re-organization of you or an arrangement with your creditors, or readjustment of your debts, or your dissolution or liquidation is filed under any law or statute; (viii) you cease your business activities, commences dissolution or liquidation; (ix) you become subject to the control of any competitive firm or company; (x) you market, sell or distribute software and/or provides services which compete with MyTarotTable Platform without receiving the prior written consent of MiniFireDragon Studios; or (xi) you breach these Terms or fail to perform any of your obligations hereunder, and such breach has not been corrected within a grace period of fifteen (15) business days from receipt of notice of breach or re-occurs after being corrected.

MiniFireDragon Studios shall not be liable to you by reason of termination, expiration or non-renewal of these Terms, for compensation, reimbursement or damages arising out of or connected with the loss of prospective profits on anticipated sales or commissions or an account of expenditures leases or commitments in connection with the business or goodwill.
Effects of Termination.
1. Upon termination of these Terms by either Party for any reason, you shall not use the MyTarotTable Platform for any purpose whatsoever.
2. Upon termination of these Terms by either Party for any reason, the license granted by MiniFireDragon Studios and any right granted by you including to any Created Content shall terminate immediately, and you shall have no further right to use the MyTarotTable Platform (including without limitation any other Intellectual Property contained therein or associated therewith) for any purpose whatsoever.
3. Termination of these Terms shall not affect MiniFireDragon Studios' rights that have accrued prior to such termination.
4. Following the effective date of termination in accordance with Section 13 herein, any terminated account will have thirty (30) days to settle all remaining open liabilities. After this period, the disposition of any rights and benefits accrued will be at the discretion of MiniFireDragon Studios.
5. Sections 7, 8, and 13 through 22 shall survive any termination of these Terms.

REFUND POLICY

In the event you are a Member, refunds may be granted within 7 days of payment for a service. You must provide a detailed reason for requesting the refund. MiniFireDragon Studios will review each request and determine on a case-to-case basis whether a refund is validated. If you would like a refund, please send an email to support@mytarottable.com. Your email must have the subject "Refund Request" and include the following information: your name, the email address you used to request the service through the Platform, the service and name of the Creator, and the reason for the refund request.

Only one discount may be used per purchase. If a coupon code is entered for the purchase of a discounted package deal, the option offering a larger discount will be applied.
Refunds for packages that were partially redeemed will be calculated according to the package price with a deduction of the original (non-discounted) price from the redeemed services.

In the event your Refund Request is accepted by Zanga, you shall have 60 days to withdraw such refund amount from your account ("Refund Withdrawal Period"). Following the Refund Withdrawal Period, any subsequent return of these funds will be at the discretion of MiniFireDragon Studios.

USER CONSENT FOR PROMOTIONAL COMMUNICATIONS

In registering for an account with MyTarotTable, you agree to our use of your personal information to send you promotional communications. By ticking the checkbox at the time of sign-up, you explicitly consent to receive emails, newsletters, special offers, and information about new products or services from MyTarotTable.

You may withdraw your consent at any time by clicking the 'unsubscribe' link at the bottom of our promotional emails or contacting our customer support directly. This however, will not stop the system from sending automated reminders, receipts, invoices, or any other messages regarding but not limited to appointments with a Creator or questions regarding your appointment with a Creator.

MyTarotTable commits to fully respect your decision to opt-out of any promotional communications and assures that your personal information will be processed in compliance with our Privacy Policy and applicable data protection laws.

PROMOTIONAL COMMUNICATIONS ON BEHALF OF CREATORS

MyTarotTable may, from time to time, promote Creator profiles, services, and availability through its marketing channels, including email communications, social media, newsletters, push notifications, and other digital channels directed at Members and prospective Members ("Creator Promotional Communications").

By registering as a Creator on the MyTarotTable Platform, you grant MiniFireDragon Studios a non-exclusive, royalty-free right to use your name, profile photo, reviews, ratings, areas of expertise, service descriptions, and any other publicly available profile information for Creator Promotional Communications.

Creator Promotional Communications are intended to drive engagement and bookings on the Platform and are part of the Services MiniFireDragon Studios provides.

MiniFireDragon Studios retains sole discretion over the content, frequency, timing, and audience of such communications. Creators may opt out of being featured in Creator Promotional Communications at any time by contacting support@hypsee.com. Opting out may limit the visibility and discoverability of your services on the Platform. MiniFireDragon Studios does not guarantee any specific results, bookings, or revenue from Creator Promotional Communications.

MINIFIREDRAGON STUDIOS DOES NOT WARRANT THAT THE PLATFORM WILL BE FREE FROM DEFECTS, IDENTIFY SECURITY VULNERABILITIES, OR THAT USE OF THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. MINIFIREDRAGON STUDIOS IS NOT RESPONSIBLE, AND HAS NO LIABILITY FOR ANY HARDWARE, PLATFORM, OR OTHER ITEM OR SERVICE PROVIDED BY ANY PERSON OR ENTITY OTHER THAN MINIFIREDRAGON STUDIOS. EXCEPT FOR ANY WARRANTIES EXPRESSLY STATED IN THESE TERMS, THE ENTIRE RISK ARISING OUT OF USE OF THE PLATFORM OR AS TO THE SATISFACTORY QUALITY, PERFORMANCE, AND ACCURACY OF THE PLATFORM REMAINS WITH YOU. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU ACKNOWLEDGE THAT MINIFIREDRAGON STUDIOS DOES NOT WARRANT OR GUARANTY THE SECURITY OF THE MYTAROTTABLE PLATFORM OR OF COMMUNICATIONS MADE USING THE MYTAROTTABLE PLATFORM, AND YOU ASSUME ALL RISKS ASSOCIATED WITH SUCH SECURITY AND COMMUNICATIONS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MINIFIREDRAGON STUDIOS BE LIABLE UNDER ANY LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, CONTRACT, TORT, NEGLIGENCE, OR STRICT LIABILITY) FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, CORRUPTION OR LOSS OF DATA, COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES, OR TECHNOLOGY) ARISING OUT OF THE SUBJECT MATTER OF THESE TERMS OR ANY RELATED AGREEMENT FOR SERVICES ENTERED INTO BY THE PARTIES OR ANY TRANSACTION BETWEEN YOU AND ANY END USER, EVEN IF MINIFIREDRAGON STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, MINIFIREDRAGON STUDIOS'S SOLE LIABILITY FOR DAMAGES ARISING UNDER THESE TERMS OR ANY RELATED AGREEMENT FOR SERVICES ENTERED INTO BY THE PARTIES SHALL BE LIMITED TO THE AMOUNT ACTUALLY RECEIVED BY MINIFIREDRAGON STUDIOS SOLELY IN CONNECTION WITH THE RESPECTIVE CREATED CONTENT AND DURING THE THREE (3) MONTHS' PERIOD IMMEDIATELY PRIOR TO THE OCCURRENCE GIVING RISE TO SUCH LIABILITY.

COMPLIANCE WITH LAWS

You shall, at all times, strictly comply with any applicable law, regulations, and/or orders, including, without limitation, any laws related to the protection of the privacy and security of personal information.

You shall, at your own expense, make, obtain, and maintain in force at all times during the term of these Terms, all filings, registrations, notices, reports, licenses, permits, and authorizations required under any applicable law, regulation or order, required to perform your obligations under these Terms.

PARTIES' RELATIONSHIP

These Terms do not create any agency, joint venture, or partnership relationship between MiniFireDragon Studios and you. You shall have no authority to act or to bind MiniFireDragon Studios in any way, to alter any of the terms or conditions of MiniFireDragon Studios's standard forms, to warrant or to execute agreements on behalf of MiniFireDragon Studios, or to represent that MiniFireDragon Studios is in any way responsible for the acts or omissions of you. You shall indemnify, defend and hold harmless MiniFireDragon Studios, its affiliates and all officers, directors, shareholders and agents thereof, from and against all losses, liabilities, damages, deficiencies, costs, judgments, and expenses (including, without limitation, reasonable attorneys' fees) incurred by, asserted against or suffered by MiniFireDragon Studios or any of the foregoing as a result of or which arise from or in connection with actions, suits, demands or claims of any nature whatsoever (including, without limitation, counterclaims or defenses) incident to your acts or omissions in connection with your performance of your obligations under these Terms and/or use and/or access of the Platform and/or Services, including without limitation, any third party claims that the Creator Content infringes any proprietary rights of any third party.

SEVERABILITY

If any portion of these Terms is construed to be illegal, invalid or unenforceable, such portion shall be deemed stricken and deleted from these Terms to the same extent and effect as if it were never incorporated herein, but all other portions shall continue in full force and effect; provided, however, that such resulting construction of the Agreement does not frustrate the main purpose of the Agreement.

GOVERNING LAW

These Terms shall be governed by and construed and enforced in accordance with the laws of the United States of America (without regard to the principles of conflicts of law embodied therein). Any claim or dispute between the parties hereto shall be decided exclusively by the competent court of Delaware, United State, to the exclusion of any other courts, and the parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non-convenient with respect to venue and jurisdiction in the courts of Delaware, United States.

NO ASSIGNMENT WITHOUT CONSENT

None of your obligations, rights, or interests, or any part thereof, arising under these Terms, may be sold, assigned, or transferred in any way, to any third party, by operation of law or otherwise, without the prior written consent of MiniFireDragon Studios.

NON-WAIVER

A failure by MiniFireDragon Studios to enforce at any time any term, provision or condition of these Terms, or to exercise any of its rights or options herein, shall in no way operate as a waiver thereof, nor shall any single or partial exercise preclude any other right or option herein; in no way whatsoever shall a waiver of any term, provision or condition of these Terms be valid unless in writing, signed by MiniFireDragon Studios, and only to the extent set forth in such writing.

DMCA PROCESS

The Digital Millennium Copyright Act of 1998 ("DMCA") provides recourse for copyright holders who believe that material on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials made available on or accessible through our Platform infringe your copyright, you may send us a notice requesting that we remove or block the material or disable access to it. If you believe in good faith that someone has wrongly filed a notice of copyright infringement against you, the DMCA permits you to send us a counter-notice.

Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA. See http://www.copyright.gov for details.

We respect the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide our Copyright Agent with the following information:

an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
a description of the copyrighted work or other intellectual property that you claim has been infringed;
identification of the URL or other specific location on our Platform and/or website and/or Services where the material or activity you claim to be infringing is located or is occurring; you must include enough information to allow us to locate the material or the activity;
your address, telephone number, and email address;
a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

ENTIRE AGREEMENT

These Terms, together with any forms and/or service orders filled-in separately by you either online or otherwise from time to time and in connection with any Created Content, constitute the entire agreement between the parties with respect to the subject matter hereof. These Terms supersede, and the terms hereof govern, any other prior or collateral agreements with respect to the subject matter hereof. Any amendments to these Terms must be in writing and executed by an authorized officer of MiniFireDragon Studios. In the event of any discrepancy between the terms and conditions of these Terms and the terms and conditions any of the aforementioned documents, the terms and conditions of these Terms shall prevail and supersede.
